NOTICE OF SALE UNDER POWER

Under and by virtue of the power of sale contained in that Deed to Secure Debt from Bruce Wayne Humphries and Dawn Humphries to Ethicon Credit Union, dated June 19, 2000, recorded among White County, Georgia Records in Deed Book 642, Page 359, the undersigned will sell at public outcry to the highest bidder for cash before the Courthouse door in said County, during the legal hours of sale, on the first Tuesday in August, 2017 by North Main Credit Union f/k/a Ethicon Credit Union, as Attorney-in-Fact for Bruce Wayne Humphries and Dawn Humphries the following described property:

All that tract or parcel of land lying and being in Land Lot Number 171 of the 2nd Land District of White County, Georgia, and being all of Tract 3, containing 0.526 acres, more or less, as delineated on Plat of Survey dated December 4, 1998, prepared by London Land Surveying, Cleveland, Georgia, and Roger N. London, Georgia Registered Land Surveyor, recorded in Plat Book 43, page 107, Office of Clerk, Superior Court, White County, Georgia. Reference is hereby made to said Plat of Survey and the record thereof for a more complete description of said property.
ALSO CONVEYED is an unobstructed and non-exclusive right of ingress and egress via the drive easement shown on the above referenced Plat of Survey as running in a Northeasterly direction (along the Southerly boundary of Tract 4 of said Plat of Survey) from the Northeasterly right-of-way of State Route 384 (a/k/a Duncan Bridge Road) to the Southwesterly boundary of the above described Tract 3 of said Plat of Survey. Said right shall not be defeated for lack of use or maintenance but shall be a covenant running with the land.
ALSO CONVEYED is an unobstructed and non-exclusive right of ingress and egress via the 20-foot drive easement shown on the above referenced Plat of Survey as running in a Northeasterly direction (along the Northerly boundary of Tract 4 of said Plat of Survey) from the Northeasterly right-of-way of State Route 384 (a/k/a Duncan Bridge Road) to the Southwesterly boundary of Tract 2 of said Plat of Survey. Said right shall not be defeated for lack of use or maintenance but shall be a covenant running with the land.
ALSO CONVEYED is an unobstructed and non-exclusive pedestrian right of ingress and egress via a strip of land 20 feet in width, which strip of land is bounded as follows: Beginning at the iron pin located at the point common to Tract 1, Tract 2 and Tract 4 as shown on the above referenced Plat of Survey; thence South 26 degrees 29 minutes 37 seconds East 20 feet to a point on the boundary line common to Tract 2 and Tract 4 of said Plat of Survey; thence North 50 degrees 36 minutes 05 seconds East 45 feet to a point near the Southerly side of the gravel drive shown on said Plat of Survey; thence North 26 degrees 29 minutes 37 seconds West 20 feet to a point on the boundary line common to Tract 1 and Tract 2 of said Plat of Survey; thence South 50 degrees 36 minutes 05 seconds West 45 feet to an iron pin at the point common to Tract 1, Tract 2 and Tract 4 as shown on the above referenced Plat of Survey, and the Point of Beginning.
ALSO CONVEYED is an unobstructed and non-exclusive right of ingress and egress over and through Tract 2 of said Plat of Survey, via the existing gravel drive and the most direct extension of said gravel drive extending from the Northerly-most boundary of the herein described 20-foot right of ingress and egress to that part of the boundary common to Tract 2 and Tract 3 of said Plat of Survey immediately opposite the Northerly-most shed shown as located on Tract 3 of said Plat of Survey. Said right of ingress and egress shall be for access to said shed.
ALSO CONVEYED is the pedestrian right of ingress and egress over and through that part of Tract 1 and Tract 2 of the above referenced Plat of Survey which part lies within ten (10) feet of the outer edge of the water pool making up said pond, together with the non-exclusive right to swim and to bank-fish in said pond.
ALSO CONVEYED is a pedestrian right of ingress and egress over and through Tract 1 of said Plat of Survey to the pond shown on said Plat of Survey, via a strip of land 5 feet in width, said strip of land running in a Northeasterly direction along and with the Southeasterly boundary of said Tract 1, from a point Five (5) feet South 50 degrees 36 minutes 05 seconds West from the Northerly-most corner of the 20-foot right of ingress and egress described herein as running over Tract 2 of said Plat of Survey, to the Southwesterly boundary of the area surrounding the pond which is burdened by the herein described 10-foot pedestrian right of ingress and egress.
SUBJECT TO existing easements for public utilities.
RESERVED AND EXCEPTED from this conveyance is an easement for any existing septic tank and septic tank drain field located on said Tract 3, which drain field serves the structures located on Tracts 1, 2 and 4 of said Plat of Survey, together with the right of ingress and egress over and through said Tract 3 for the purpose of repairing, replacing, and maintaining such septic tank and septic tank drain fields. Said easement and attendant right and easement shall be for the benefit of each and all of said Tracts 1, 2 and 4 shown on the above referenced Plat of Survey whih are served by such septic tanks and septic tank drain fields.
ALSO CONVEYED is an easement for any existing septic tank and septic tank drain field which serves the structures on Tract 3 of said Plat of Survey, and which lie outside the boundaries of said Tract 3, together with the right of ingress and egress over and through said Tracts 1, 2 and 4 for the purpose of repairing, replacing, and maintaining such septic tank and septic tank drain fields. Said easement and attendant right and easement shall be for the benefit of each and all of said Tract 3.
ALSO CONVEYED are all rights, title and interest, if any there be, of Deborah Humphries Payne, Robert Mitchell Humphries and Ernest Darrell Humphries in and to the mobile home shown on the above referenced Plat of Survey as lying within the boundaries of Tract 2 of said Plat of Survey.

The indebtedness secured by said Deed to Secure Debt having been declared due and payable because of default in the payment of said indebtedness, among other possible events of default, this sale will be made for the purposes of paying the same and all expenses of sale, including attorney's fees (notice having been given as provided by law).
The property will be sold subject to the following:
(1) all prior restrictive covenants, easements, rights-of-way or encumbrances; (2) all valid zoning ordinances; (3) matters which would be disclosed by an accurate survey of the property; (4) the outstanding ad valorem taxes and assessments, if any; (5) unpaid water and sewage bills, that constitute liens against the property, whether due and payable or not yet due and payable; and (6) matters of record superior to the security deed first set out above.
To the best of the undersigned's knowledge and belief, the parties in possession are Bruce Wayne Humphries and Dawn Humphries or a tenant or tenants.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Deed to Secure Debt.
